Simon Wiesenthal Center Letter to Spain’s Transport Minister on Vueling Incident

Request for Investigation and Disclosure Regarding Vueling Airlines Incident to Oscar Puente, Ministerio de Transportes y Movilidad Sostenible

Dear Minister Puente,

I am writing to you on behalf of the Simon Wiesenthal Center, an international Jewish human rights organization accredited with observer status at the United Nations.

We are deeply concerned regarding the widely reported incident aboard Vueling Airlines flight 8166 in which a group of French nationals was removed from the aircraft and, more specifically, a 21-year-old female camp counselor was shown on video being thrown to the ground, handcuffed, and detained.

According to multiple news sources, it has been alleged that this individual was required to sign a non-disclosure agreement as a condition of her release.

In the interest of transparency and justice, we respectfully request the following:

1. Confirmation of Facts:

• Can your office confirm whether a non-disclosure agreement was indeed imposed on this individual as a condition of her release?
• If so, what were the circumstances and legal basis for this demand?

2. Rescission of Non-Disclosure:

• If such a non-disclosure agreement exists, we formally request that it be rescinded immediately, so that the individual may speak openly and without fear of retribution about her experience and the experience of the teenagers she was responsible for.
• Please indicate what steps your office will take to facilitate the rescission of this agreement.

This issue will not be resolved until the full details of this incident are known.

We respectfully request a written response within 48 hours of receiving this letter to these questions and concerns. We are also prepared to meet with you or your representatives to discuss this matter further.

Thank you for your attention to this urgent issue. We look forward to your prompt reply and to working together to ensure transparency and justice in this matter.

Me dirijo a Ud en nombre del Centro Simon Wiesenthal, Organización Judìa Internacional de Derechos Humanos acreditada como Observadora ante Naciones

Unidas.

Nos encontramos profundamente preocupados por el incidente ampliamente reportado sobre Aerolíneas Vueling, vuelo 8166 en el que un grupo de ciudadanos franceses fueran removidos de la aeronave y, más específicamente, una joven de 21 años, consejera de campamento fuera exhibida en un video recostada en el suelo, esposada y detenida.

De acuerdo con multiples fuentes de noticias, se ha alegado que esta joven fuera obligada a suscribir un acuerdo de no divulgación como exigencia para ser liberada.

En el interés de transparencia y justicia, respetuosamente solicitamos lo siguiente:

1. Confirmación de los hechos:

• ¿Está Ud en condiciones de confirmar que se le ha impuesto la firma de un acuerdo de no divulgación como exigencia a esa sujeto para ser liberada?
• En tal caso, ¿Cuáles son las circunstancias y bases legales para esa demanda?

2. Rescisión de no divulgación:

• Si ese acuerdo de no divulgación existiere, formalmente le requerimos que sea dejado sin efecto en forma inmediata, de modo que la sujeto pueda hablar abiertamente y sin temor a represalias sobre la experiencia que los adoescentes a su cargo han sufrido.
• Por favor, indique que pasos seguirá su oficina para facilitar que dicho acuerdo de no divulgación sea dejado sin efecto.

Este incidente no se resolverá hasta que se conozcan los detalles en forma ìntegra.

Respetuosamente requerimos una respuesta por escrito dentro de las 48 horas de recibida la presente con sus preguntas e inquietudes. Del mismo modo, estamos dispuestos a encontrarnos con Ud., o quien Ud. Indique como su representante para conversar sobre cómo proseguir.
