A Buenos Aires Appeals Court has ruled that the trade of objects related to Nazi Germany constitutes a crime by encouraging or inciting persecution or hatred against persons orgroups by reasons of race, religion, nationality or political ideas. A police operation on June 29, 2017, confiscated headgear, helmets, weaponry, buckles and medals of the Third Reich, from an antiques store in Buenos Aires. The judges maintainedthat "this commerce keeps alive the flames of perversion, but on the other hand, also preserves the memory of what that social and political phenomenon was capable of ...",ruling ita crime.
"Selling medals and belt buckles from what that regime considered virtuous is not a mere historical interest without moral judgement, it also feeds the symbolic fuel that was thesource of massacres," said the Dr. Ariel Gelblung, Simon Wiesenthal Center's Latin American Representative
Dr. Shimon Samuels, the Center's Director for International Relations, added: "Argentina gave refuge to countless Nazi criminals and their volunteer collaborators whom, for years,kept such memorabilia as hidden trophies, occasionally bringing them out to celebrate Hitler's birthday and other fetes under the dictatorships. As they leave the scene, theseobjects enter the market, ostensibly for 'collectors', many of whom may be captivated and drawn to the ideology they represent... their criminalization may be seen as a late gesturesuggesting: 'If you cannot arrest the perpetrator, confiscate his appurtenances so that they are not purchased by a new generation to again stimulate hate'."
"We praise this ruling and will present it in other countries as a best practice in combating bigotry," SWC officials concluded.

El Centro Wiesenthal Recibe con Satisfacción el Fallo que Tipifica como Delito la Venta de Parafernalia Nazi
Buenos Aires, 14 de septiembre de 2018
La Cámara de Apelaciones en lo Penal, Contravencional y de Faltas, Sala III de la Ciudad de Buenos Aires interpretó que el comercio de objetos relacionados con la Alemania Naziconstituye el delito de alentar o incitar a la persecución o al odio contra personas o grupos por razones de raza, religión, nacionalidad o ideas políticas.
Refiriéndose al operativo policial que el 29 de junio de 2017 secuestró en un local de antigüedades del barrrio de San Telmo, Ciudad de Buenos Aires, gorras, cascos, armas, hebillasy medallas del III Reich, los jueces sostienen que “con estas ofrendas al comercio se persigue mantener viva la llama de aquella perversión o, en cambio, preservar la memoria de loque fue capaz aquél fenómeno social y político…”, configurándose el delito que la ley prevé.
“Poner a la venta medallas y hebillas de cinturones que premiaban lo que en ese régimen se consideraba virtuoso no es una actividad relacionada con un mero interés histórico sinvaloración moral, sino alimentar el combustible simbólico que constituyó el fundamento de la masacre”, sostuvo el Dr. Ariel Gelblung, Representante del Centro Simon Wiesenthal paraAmérica Latina.
Dr. Shimon Samuels, Director de Relaciones Internacionales del Centro, agregó: "Argentina dio refugio a innumerables criminales nazis y sus colaboradores voluntarios que, duranteaños, guardaron tales recuerdos como trofeo oculto, sacándolos ocasionalmente para celebrar el cumpleaños de Hitler y otras fiestas bajo las dictaduras. A medida que salen de laescena, estos objetos entran al mercado, ostensiblemente para 'coleccionistas', muchos de los cuales pueden ser cautivados y atraídos por la ideología que representan ... sucriminalización puede verse como un gesto tardío sugiriendo: 'si no puedes arrestar al autor, confisca su accesorios para que no sean comprados por una nueva generación paraestimular el odio otra vez ".
"Celebramos este fallo y lo presentaremos en otros países como una mejor práctica para combatir el fanatismo", concluyeron los funcionarios.
