In his first press conference as elected president of Argentina, Mauricio Macri, announced that he will request that Congress dissolveArgentina's Memorandum with Iran on the AMIA bombing.
This position repeats both his response to the Center´s September poll of all the Presidential candidates (http://www.lanacion.com.ar/1829593-los-candidatos-fijaron-sus-politicas-ante-iran-y-el-caso-amia)and his follow up to our question at the televised Presidential debate in November.
The Memorandum was declared unconstitutional by the Judiciary. This was appealed by the outgoing government, which will maintain the majorityin the Senate after the 12 December inauguration.
"One solution would be the withdrawal of this appeal by the new executive power, which would render the unconstitutionality a 'res judicata'status, thus annulling the Memorandum without further recourse to the legislature," argued Dr. Ariel Gelblung, Representative for Latin America of the Simon Wiesenthal Center.

En su primera conferencia de prensa como presidente electo de Argentina, Mauricio Macri anunció que solicitará al Congreso que derogue elMemorandum de entendimiento entre Argentina e Irán sobre el atentado a la AMIA.
Esta posición concuerda tanto con la respuesta brindada a la encuesta que el Centro efectuó a todos los candidatos presidenciales (http://www.lanacion.com.ar/1829593-los-candidatos-fijaron-sus-politicas-ante-iran-y-el-caso-amia)como con la postura adoptada frente a la pregunta que sugiriéramos a los organizadores del debate presidencial televisado en noviembre
.
El Memorandum fue declarado inconstitucional por el Poder Judicial. Esta resolución fue apelada por el gobierno saliente, que mantendrá lamayoría en el Senado después del cambio de mando.
"Una solución sería desistir de este recurso en casación por el nuevo poder ejecutivo, dejando la inconstitucionalidad de un estado de cosajuzgada, sin necesidad de declarar la derogación del memorandum por parte del congreso ", sostuvo el Dr. Ariel Gelblung, Representante para América Latina del Centro SimonWiesenthal.
